Terms of use for the calculation tools on tribotech.dk

Use of the tools is entirely at the user's own risk. Quality assurance of the calculated result rests with the user.

The tools perform a calculation based on the values entered and the published methods identified. They do not constitute an examination of an asset, a diagnosis, or advice on any specific asset. The tools have no knowledge of the asset's design, history, loading or operating conditions, and a result cannot therefore serve on its own as the basis for a technical or operational decision. A result is an indication, not a diagnosis.

Any decision taken on the basis of a result — including a decision not to act — is taken by the user on the user's own professional judgement and at the user's own risk. As CIGRE itself puts it: "Actual actions on the equipment are the sole responsibility of engineers in charge of the transformers" (CIGRE Technical Brochure 771, 2019, section C.8, printed page 54).

The tools are calculation tools made available free of charge by TriboTech ApS as part of the professional communication of its engineering consultancy. They are generic and are not tied to any particular asset. No fee is charged for their use.

Use of the tools does not create a client relationship and does not create an advisory relationship. TriboTech ApS provides advisory services only under a concluded framework agreement, and no advisory liability is assumed for the use of results from the tools outside such an agreement.

The tools are directed at professionally qualified users and presume a professional assessment of the calculated result. They are not intended for consumer use.

The liability of TriboTech ApS in connection with the tools is governed by the general rules of Danish law on damages. No liability is assumed beyond that which follows from applicable law.

No warranty is given as to the accuracy, completeness or fitness for any particular purpose of the results, and no warranty is given as to the availability or uninterrupted operation of the tools.

Liability for loss of production, loss of profit, loss of data and other indirect loss is excluded to the extent permitted by applicable law.

These exclusions do not apply to liability for intent or gross negligence, nor to liability which cannot be excluded or limited under mandatory law.

Each tool states which published methods and which editions the calculation is based on. The standard itself is the authoritative source, and a standard may have been revised since the edition a tool uses. Rights to the content of the standards and technical publications referred to by the tools belong to the respective rights holders.

Systematic extraction of the limit values and the threshold basis the tools calculate against is not permitted. This includes scraping, automated queries, repeated queries at scale, and reverse engineering of the underlying data. No right of machine access to the tools is granted. Technical interfaces are reserved for use by TriboTech ApS itself, and their use without prior written agreement is not permitted.

Results from the tools may not be offered, resold or incorporated commercially as a standalone product or service.

The tools may be changed, restricted or withdrawn without notice, and no operational obligation is assumed.

These terms and any dispute arising out of or relating to the tools are governed by Danish law. The tools are made available from Denmark. Disputes shall be decided by the Danish courts, and venue shall be the registered seat of TriboTech ApS.

These terms carry a version and a date. Each version is archived together with the edition of the tools, the threshold basis and the disclaimers that were in production while that version applied. The archive is retained for 30 years from the date a version is taken out of production.

A new version applies from its publication and has no effect on results calculated under an earlier version.
